    Fees are the same for any additional time spent on document review, research, written findings of fact/law and other outside time, if any, necessary to prepare or make an informed award or evaluation.

    MINIMUM TIME:
    A 3-Hour Minimum will be charged in all cases.

    For travel time charges for mediations & arbitrations held at locations other than at BAY’s offices in Atlanta, please contact BAY.>

    ALL CHARGES WILL BE SHARED EQUALLY AMONG ALL PARTIES, UNLESS OTHERWISE AGREED IN WRITING. RATES MAY BE ADJUSTED FOR SPECIAL SITUATIONS. THE FEE IS TO BE AGREED UPON IN ADVANCE.

    OUR CONTRACT FOR SERVICES IS WITH THE ATTORNEY(S). WE EXTEND CREDIT, WITH NO ADVANCE DEPOSIT REQUIREMENT, BASED ON THE ATTORNEY’S CREDIT. THE ATTORNEY, IN TURN, COLLECTS FROM HIS/HER CLIENT. THEREFORE, WE EXPECT PAYMENT FROM THE ATTORNEY(S) REGARDLESS OF CLIENT ACTIVITY. ALL FEES MUST BE PAID IN FULL ON EVERY ARBITRATION PRIOR TO THE AWARD BEING PUBLISHED.

    *** A FINANCE CHARGE OF 1.50% PER MONTH (18% PER YEAR) WILL BE CHARGED ON BALANCES DUE OVER 45 DAYS.

Adele Vespa is available to travel for mediations anywhere North East and some West Coast Cities- LA, San Francisco; Las Vegas.

Adele Vespa has specialized in franchise law, real estate law, and other corporate/asset business transactions for over 34 years. She is licensed in Ohio, Georgia and had a limited in-counsel in New Jersey. Ms. Vespa was certified as a mediator and arbitrator with training by HENNING in 2010 and became a Neutral with the State of Georgia from 2010-2016. She has mediated several franchise disputes in restaurant, janitorial, and real estate brokerage franchise industries.

Ms. Vespa represented dozens of franchisors and franchisees in private practice and as in-house counsel since 1984. Ms. Vespa recently retired from her Vice President and General Counsel position with Coldwell Banker Real Estate LLC (a subsidiary of Realogy Holdings), one of the largest residential and commercial real estate brokerage franchise companies in the country with other 3000 franchised residential offices and 86,000 affiliated real estate agents. Her widespread experience in that role included, among other matters, in-house mediation skills leading to successfully resolving many disputes (15-20 annually) between Coldwell Banker and its franchisees and their counsel, to avoid costly litigation in over 90% of disputed matters. Often, the win/win resolution involved negotiated payment plans, promissory notes, modifications to the franchise obligations and agreement, or a mutual termination and release agreement.

Her prior legal experience includes serving as Chief Franchise Counsel for Popeyes Restaurants with other 2000 restaurants domestically and internationally and Assistant General Counsel for Huddle House, Inc. in Atlanta, Georgia for approximately 10 years handling all regulatory, franchise contract negotiations, and regular dispute resolution for those two sophisticated franchise systems.

In private practice with top law firms in Ohio and Georgia, she represented Wendy’s International, Stanley Steemer International, Philly Steak Connection, Realty Executives and many other start-up franchisors or prospective franchisees seeking investment opportunities. Additionally, Ms.Vespa’s private practice experience included representing commercial real estate developers, lending institutions, buyers, sellers, landlords and tenants of commercial real properties in a variety of commercial transactions. She also served as Lead Real Estate Counsel for Bank One Corporation for most of the ’90s.

Ms.Vespa graduated law school in 1984 Cum Laude, from Capital University Law School in Ohio. She has been a member of the American Bar Association Franchise Forum Since 1987.
