    Fees are the same for any additional time spent on document review, research, written findings of fact/law and other outside time, if any, necessary to prepare or make an informed award or evaluation.

    MINIMUM TIME:
    A 3-Hour Minimum will be charged in All Cases

    TRAVEL TIME:
    For travel time for hearings outside the metro Atlanta area, $125.00 per hour will be charged, in addition to travel expenses including, but not limited to airfare, mileage, car rental, lodging and meals.

    ALL CHARGES WILL BE SHARED EQUALLY AMONG ALL PARTIES, UNLESS OTHERWISE AGREED IN WRITING. RATES MAY BE ADJUSTED FOR SPECIAL SITUATIONS. THE FEE IS TO BE AGREED UPON IN ADVANCE.

    OUR CONTRACT FOR SERVICES IS WITH THE ATTORNEY(S). WE EXTEND CREDIT, WITH NO ADVANCE DEPOSIT REQUIREMENT, BASED ON THE ATTORNEY’S CREDIT. THE ATTORNEY, IN TURN, COLLECTS FROM HIS/HER CLIENT. THEREFORE, WE EXPECT PAYMENT FROM THE ATTORNEY(S) REGARDLESS OF CLIENT ACTIVITY. ALL FEES MUST BE PAID IN FULL ON EVERY ARBITRATION PRIOR TO THE AWARD BEING PUBLISHED.

    *** A FINANCE CHARGE OF 1.50% PER MONTH (18% PER YEAR) WILL BE CHARGED ON BALANCES DUE OVER 45 DAYS.

    CANCELLATION/RESCHEDULE POLICY:
    If a Mediation or Arbitration is postponed, rescheduled or canceled for any reason WITHIN FOURTEEN (14) DAYS OF THE MEDIATION, the Responsible Party(s) will be charged a THREE-HOUR MINIMUM at the FULL hourly rate for all parties in the entire case, as stated on BAY Mediation & Arbitration Services, LLC Fee Structure Sheet, included with the Confirmation Letter when the Mediation or Arbitration was scheduled. I, Clarence Cuthpert, Jr. served several years in the judiciary as Probate Judge, and Chief State Court Judge. As Probate Judge, Cuthpert presided over several bench trials pertaining to guardianships, conservatorships, and estate matters. In his role as Chief State Court Judge, Cuthpert presided over countless criminal trials, and civil trials to include a wide range of issues from negligence to medical malpractice.

In April 2020, Judge Cuthpert was appointed by the Supreme Court of Georgia to the Commission on Dispute Resolution as the first ever probate judge to serve on the Commission. During his tenure with the Commission Judge Cuthpert has served on the Outreach Committee, and currently serves as Chairperson of the Budget and Personnel Committee as well. He has been a registered Mediator and Arbitrator since 2006.

In March 2018, Judge Cuthpert was appointed as the representative for the Probate Courts on the Judicial Council’s Standing Committee on Access to Justice. The Committee’s mission is to improve the public’s trust in the judicial branch by promoting meaningful and effective access to courts and fairness for all. Judge Cuthpert continued serving on the Committee in his capacity as Chief State Court Judge.

Prior to serving in the judiciary, Cuthpert practiced law throughout the State of Georgia for 20 years. He handled complex litigation issues pertaining to Employment, Civil Rights, Administrative, Discrimination, Probate, Criminal, Personal Injury, Family, & Wrongful Death areas of law. He is admitted to the U.S. Court of Appeals, 11th Circuit, U.S. District Court for the Northern, Middle and Southern Districts, Georgia Supreme Court, Georgia Court of Appeals, and the Superior and State Courts of Georgia.

Judge Cuthpert received his Bachelor of Science degree from Savannah State University, Master of Public Administration degree from Georgia Southern University, and Juris Doctor degree from Nova Southeastern University.
