Administrative Fee
$200.00 per party/per dayThis fee will be charged to any cancelling party- in addition to any fee charged by the mediator – in the event your mediator elects to charge his or her cancellation fee. BAY admin fees will not be charged a second time if the mediation is rescheduled.
Mediation / Arbitration Hourly Fees
Thomas Lyman conducts mediations on a full-day, flat-fee basis. Fees are charged per party, based on the number of participating parties:
- Two-party cases: $2,000 per party
- Three-party cases: $1,750 per party
- Four or more parties: $1,500 per party
The full-day mediation fee includes reasonable pre-mediation preparation (including review of mediation statements and key materials), the mediation session itself, and reasonable post-session follow-up communications and negotiations related to the mediation. No additional hourly charges are assessed for preparation time or follow-up efforts.
Mediations are scheduled on a full-day basis only; half-day rates are not offered.
TRAVEL TIME:
For travel time for hearings outside the metro Atlanta area, $125.00 per hour will be charged, in addition to travel expenses including, but not limited to airfare, mileage, car rental, lodging and meals.ALL CHARGES WILL BE SHARED EQUALLY AMONG ALL PARTIES, UNLESS OTHERWISE AGREED IN WRITING. RATES MAY BE ADJUSTED FOR SPECIAL SITUATIONS. THE FEE IS TO BE AGREED UPON IN ADVANCE.
OUR CONTRACT FOR SERVICES IS WITH THE ATTORNEY(S). WE EXTEND CREDIT, WITH NO ADVANCE DEPOSIT REQUIREMENT, BASED ON THE ATTORNEY’S CREDIT. THE ATTORNEY, IN TURN, COLLECTS FROM HIS/HER CLIENT. THEREFORE, WE EXPECT PAYMENT FROM THE ATTORNEY(S) REGARDLESS OF CLIENT ACTIVITY. ALL FEES MUST BE PAID IN FULL ON EVERY ARBITRATION PRIOR TO THE AWARD BEING PUBLISHED.
*** A FINANCE CHARGE OF 1.50% PER MONTH (18% PER YEAR) WILL BE CHARGED ON BALANCES DUE OVER 45 DAYS.
CANCELLATION/RESCHEDULE POLICY:
A two-week cancellation notice is requested. Cancellation terms may be adjusted in the event of early communication or good-faith resolution prior to the mediation date. The responsible party(s) will be charged $3,000.
Bio
Thomas J. Lyman is a full-time civil mediator with extensive experience resolving complex personal injury, wrongful death, and insurance disputes throughout Georgia. With more than a decade of civil litigation experience, he brings a balanced and practical understanding of case valuation, risk assessment, and litigation pressure points to each mediation.
Thomas has mediated hundreds of cases statewide, including automobile and trucking collisions, wrongful death matters, premises liability and negligent security claims, insurance coverage disputes, bad faith and extra-contractual claims, and subrogation issues. His litigation background allows him to quickly identify the legal and factual drivers of a case and focus the parties on the issues that most directly impact resolution. When appropriate, he is comfortable addressing risk, valuation, and case posture while maintaining a party-driven process.
Thomas is known for his preparation, direct but respectful facilitation style, and ability to keep parties engaged in highly contested matters. He works effectively with insurers, self-insured entities, national defense firms, and local counsel to move cases toward efficient, durable resolutions.
Thomas holds an AV Preeminent® rating from Martindale-Hubbell and has been named to the Super Lawyers® Rising Star® or Super Lawyer® lists annually since 2015. He has been a registered neutral with the Georgia Office of Dispute Resolution since 2010 and is a distinguished member of the National Academy of Distinguished Neutrals.
